Terms of Service

1. Purpose

These Terms of Service ("Terms") govern access to and use of the Bindex mobile application ("the App"), edited by Bindex, Paris, France ("the Editor"). The App is a tool to help estimate prices of Pokemon TCG collectible cards. By creating an account or using the App, you accept these Terms without reservation.

2. Service description

  • Card search: indicative pricing from public sources (Cardmarket, TCGPlayer, agrégateur de données de marché tiers situé en UE)
  • Card scanner: identification via the phone camera
  • Portfolio: manual collection tracking with total value estimate
  • Watchlist: price-evolution tracking on selected cards
  • Calculator: helper tools (Expected Value, ROI)

3. Account

3.1 Creation

An account requires a valid email and a password. You guarantee the accuracy of the information you provide.

3.2 Security

You are solely responsible for the confidentiality of your credentials. Any activity from your account is presumed yours. In case of unauthorized use, notify the Editor immediately at privacy@getbindex.io.

3.3 Minimum age

The App is reserved for users aged 13 and up. For users under 16, parental consent is required per the GDPR.

4. Plans and pricing

Free: limited monthly scans, limited watchlist and portfolio, access to basic features.

Premium / Ultra (paid subscriptions): higher quotas, advanced features, priority support. Final pricing is shown in-app and on the App Store / Google Play.

Subscriptions are purchased via Apple's or Google's in-app billing systems. Billing, renewal and cancellation are managed by the relevant platform.

5. Intellectual property

5.1 Third-party marks

Pokemon, Pokemon TCG, and all related marks, names, images and logos are the exclusive property of The Pokemon Company, Nintendo and their partners. The App is not affiliated with, endorsed by, or sponsored by these entities.

5.2 App content

Source code, design, original copy and features are the property of the Editor. Unauthorized reproduction is prohibited.

5.3 Price data

Price data shown in the App is sourced from third parties (Cardmarket, TCGPlayer, agrégateur de données de marché tiers situé en UE). The Editor is not responsible for accuracy or completeness.

6. Price data — Disclaimer

Prices shown in the App are indicative only and do not constitute purchase, sale or investment advice. The Editor does not guarantee the accuracy, completeness or freshness of price data. Real prices may vary significantly based on card condition, market, sales platform and other factors.

You are solely responsible for your buy / sell decisions. The Editor disclaims any responsibility for financial loss related to use of App data.

7. User content

7.1 Scan images

Images captured by the scanner are processed for identification and are not permanently stored on our servers. When debug mode is enabled, images may be temporarily retained for up to 7 days for service quality improvement, then automatically deleted.

7.2 Portfolio data

Portfolio information (owned cards, declared purchase prices) is entered manually by you and stored on our servers to allow cross-device sync.

7.3 License

By using the App you grant the Editor a non-exclusive, worldwide, royalty-free license to process your data within the scope of operating the service.

8. User behavior

You agree not to: use the App for illegal purposes, attempt to circumvent the limitations of the free plan, perform scraping / reverse engineering / automated extraction, disrupt the App or its servers, or create multiple accounts to bypass quotas. Any violation may result in suspension or deletion of the account.

9. Suspension and termination

You can delete your account at any time from in-app settings or by contacting privacy@getbindex.io. Deletion erases all your data within 30 days. The Editor may suspend or delete an account in case of breach of these Terms, without notice or compensation.

10. Limitation of liability

The App is provided "as is". The Editor does not guarantee uninterrupted availability, the absence of bugs, or the accuracy of price or identification data. To the maximum extent permitted by law, the Editor's liability is limited to the amounts paid by you in the previous 12 months. The Editor is not liable for indirect damages, including lost profits, lost data, or lost opportunity.

11. Service availability

The Editor strives to maintain 24/7 availability but offers no contractual commitment thereto. Maintenance, updates and force majeure interruptions are possible.

12. Changes

The Editor may update these Terms at any time. Material changes will be communicated via in-app notification. Continued use after notification constitutes acceptance of the new Terms.

13. Governing law and jurisdiction

These Terms are governed by French law. In case of dispute, the parties shall seek an amicable solution. Failing that, the competent courts of Paris shall have exclusive jurisdiction. Consumer mediation per Articles L.611-1 et seq. of the French Consumer Code is available.
